HSE Seeks Feedback on Asbestos Regulations

The Health and Safety Executive (HSE) has launched a consultation on proposals to improve the Control of Asbestos Regulations 2012 and associated guidance.

The initiative aims to enhance protection for workers and building occupants, particularly in areas where asbestos exposure remains a significant health risk.

Great Britain is already recognised for strong workplace health and safety, with some of the lowest rates of occupational injury and fatalities in Europe. These proposals build on this foundation by targeting areas where asbestos continues to pose serious risks.

Key Proposals Under Consultation

The consultation invites stakeholders’ views on three main areas:

  1. Independence in Clearance Processes – Ensuring impartiality in the four-stage asbestos clearance procedure to minimise exposure risks after asbestos removal.

  2. Higher Standards for Asbestos Surveys – Improving the quality and reliability of surveys to provide dutyholders with the information needed to manage asbestos safely.

  3. Clarification of Notifiable Non-Licensed Work (NNLW) – Defining the types of work that fall under NNLW to reduce ambiguity in regulatory compliance.

This consultation is particularly relevant for dutyholders, asbestos analysts, removal contractors, surveyors, and professionals in facilities management and construction.

HSE Emphasises Worker and Public Safety

Rick Brunt, Director of Engagement and Policy at HSE, said:

“Asbestos continues to be a significant risk to workers in Great Britain. While we have made significant progress in managing asbestos risks, these proposals represent an important step towards further strengthening protections for workers and the public.

“We want to hear from all stakeholders involved in the asbestos regulatory system to ensure our approach is both effective and proportionate, supporting HSE’s commitment to protecting people and places whilst enabling innovation and economic growth.”

Government Highlights Asbestos Risks

Sir Stephen Timms, Minister for Social Security and Disability, added:

“The dangers of exposure to asbestos are well known. Its legacy is that it remains the biggest cause of work-related deaths in the UK, responsible for over 5,000 deaths per year, with many more people living with the impact of asbestos-related disease.
This consultation aims to improve these regulations and enhance worker and public protection from asbestos exposure.”
